WEST BATH

Voters at a special town meeting Monday will consider spending up to $55,000 more to sue Regional School Unit 1.

The meeting, at the fire station, begins at 6 p.m.

West Bath is seeking $1.9 million from RSU 1 — a sum that includes interest — claiming it overpaid the school district in the first four years of its existence.

The town says it should have been assessed $8.2 million in fiscal years 2008, 2009, 2010 and 2011 but instead paid $10.1 million.

The towns of Arrowsic, Bath and Woolwich have joined RSU 1 as defendants, since they would be compelled to pay more should West Bath prevail.

Thus far, West Bath has authorized spending of $46,500. The new request, according to the special town meeting warrant, is for “unanticipated legal fund and litigation fund expenses for the time period February 25, 2013 to June 30, 2013.”

Residents approved the original $46,500 during a special town meeting last June.

“This wasn’t on our radar to the level it is now,” said Jonathan Davis, town administrator.

The next court date is March 5, beginning at 8:30 a.m., at Sagadahoc Superior Court in Bath. There will be oral arguments on a motion to dismiss, Davis said.
