The Office of the Attorney General has determined that a Westbrook police officer who fired a rifle at a Portland man in early November was justified in doing so.

In a Feb. 13 release, Westbrook police also announced that, following an investigation by the Cumberland County District Attorney’s office, arrest warrants have been issued for two persons authorities say are responsible for making the false 911 call that brought the police to the scene.

Officer Phil Robinson returned to active duty in December after more than a month on administrative leave, despite an ongoing investigation by the Attorney General’s office into the incident.

At the time, Westbrook police had found no fault in Robinson’s actions and allowed him to return to duty.

“Our investigation didn’t reveal a problem with Officer Robinson’s actions, so we brought him back,” Capt. Tom Roth said when Robinson returned to the force.

The Office of the Attorney General came to the same conclusion last week.

Following a separate review of the incident by the district attorney’s office, warrants for Class D False Public Alarm or Report have been issued for Deborah Dickerson, 55, and Audrey Thompson, 59, of Westbrook Pointe.

According to the police report, Robinson and Officer Steve Pulsoni responded to a call from the housing project at around 10 p.m., reporting a woman screaming and gunshots near the project’s office. When the two officers arrived at the scene, they spotted a suspicious, unoccupied vehicle with the driver’s door open.

As they approached, police said, a man ran from behind a building, jumped into the vehicle and made a U-turn in an attempt to leave.

Police said the vehicle failed to stop when commanded by Robinson and Pulsoni and swerved toward Robinson after nearly hitting Pulsoni. Robinson, in fear of being struck, fired at the car, which then stopped.

The officers removed the driver from the car and cuffed him before releasing him without arresting him.

The driver said that he thought he was being robbed, despite the fact that the two officers were in uniform.

No injuries were reported in the incident, and the vehicle received minor damage.
