For the third consecutive month the parties involved in the debate over the development of Trundy Point have requested the issue be tabled until the next Cape Elizabeth Zoning Board of Appeals meeting. It will next be on the agenda for the July 26 meeting at Town Hall.

Pya Chang, the owner of the property at 24 Reef Road in the Shore Acres neighborhood, was issued a building permit in February. That property contains the scenic ledge known as Trundy Point.

Neighbors appealed the decision by Cape Elizabeth Code Enforcement Officer Bruce Smith to approve a building permit because they said a home on that property would restrict their view of the ocean. Property deeds in the neighborhood restrict homes to one story for that purpose, but homes could still be close to 40 feet high and still conform to the deeds, Smith has said.

It has only been since last fall that the property in question has been eligible for development. At that time the property owner’s son, Adam Mack, bought the abutting one-house lot and moved the property line between the two to allow for a large enough building envelope at 24 Reef Road to accommodate a structure and meet all zoning ordinances.

Mack said negotiations between the two parties were ongoing and did not wish to comment at this time. John Fatula, the neighbor who lives across the street from the proposed home and filed the appeal, did not return phone calls.
