BUXTON —A Buxton man, charged by state police last year with attempted murder and elevated aggravated assault, seeks court approval this week to drop a bail condition prohibiting him from entering the town of Hollis.
A hearing to amend bail conditions for Brandon Lasante, 20, has been set for 8:30 a.m. on Friday, Aug. 24, at York County Superior Court in Alfred.
State and local police investigated an incident in Buxton at 2:35 a.m. on Aug. 6 last year outside 58 Old Orchard Road, where police said Lincoln Kimball of Hollis, 28, had been shot. A court affidavit by a state police detective shows that Lasante lived at that address and that he reported the incident in a 911 call, stating, “he just shot someone.”
Michael Whipple, Lasante’s lawyer, told the American Journal Wednesday that Lasante’s position is that he was acting in self defense.
According to the affidavit, Lasante told investigators he “heard and saw” a chunk of cement come through a front window. He then went outside with a shotgun, fired warning shots “in the air” and told Kimball to get off his property.
Lasante told a state detective, according to the court affidavit, that “Kimball ran back to his vehicle and then came back towards him” and was in his driveway when he fired.
A state police press release at that time said Kimball was “struck with several pellets from a shotgun.” Police said Kimball was taken to Maine Medical Center.
Buxton police later arrested Lasante and took him to York County Jail. Lasante was released on $20,000 cash bail and $100,000 in real estate.
Bail conditions included not entering Hollis and having no contact with Kimball and Mckenna Matwyko, who Lasante says, according to the court affidavit, both he and Kimball had dated.
In a motion filed in court on July 25, Whipple wrote it’s a hardship for Lasante to stay out of Hollis because of major highways crossing through the town and a financial hardship because Lasante is unable to to work for paving customers in Hollis.
Last Month, Buxton police charged Kimball and another driver, Bryson Geary of Hollis, 20, following an incident on Salmon Falls Road involving Lasante. Police said on July 3 that Kimball passed Lasante, who had a passenger and was towing a boat and a trailer.
“Kimball allegedly drove his vehicle recklessly and Lasante believed Kimball and Geary were trying to stop him,” police said.
Police said Kimball hit his brakes and Geary struck the boat and trailer and launched the boat off the trailer.
“Both Kimball and Geary fled the scene and were unavailable for questioning,” police said.
Police subsequently charged both Kimball and Geary with reckless conduct with a dangerous weapon (motor vehicle) and aggravated criminal mischief. Geary was also charged with violation of conditions of release.
Whipple said the recent road attack was “violent” and Lasante could have been killed.
