NOTICE OF PUBLIC SALE
Pursuant to
14 M.R.S. § 6203-A et. seq.
and December 29, 2016 at
10:00 a.m., 44 Alfred
Street, Biddeford, Maine
For default of, and breach
of the condition contained
in, that certain Mortgage
from B and D Real Estate,
LLC (the “Mortgagor”), to
Maine Bank & Trust Com-
pany n/k/a People’s United
Bank, N.A. (the “Mortga-
gee”) dated September 28,
2007, recorded at the York
County Registry of Deeds
in Book 15268, Page 755,
and recorded at said Regis-
try of Deeds in Book 15275,
Page 300 (the “Mortgage”),
and for the purpose of fore-
closing the same, by virtue
of and in execution of the
Power of Sale contained in
the Mortgage, there will be
sold at Public Sale at 10:00
a.m., on December 29,
2016, at 44 Alfred Street,
Biddeford, Maine, all and
singular, the real property
described in the Mortgage
(the”Mortgaged Premises”),
to wit:
A certain lot or parcel of
land with the buildings
thereon, situated on the
northwesterly side of Alfred
Street in the City of Bidde-
ford, County of York, and
State of Maine being
bounded and described as
follows:
Beginning on said Alfred
Street on the northwesterly
corner of land now or for-
merly of Jere Goldsbor-
ough;
Thence northwesterly by
the northerly line of land
now or formerly of said
Goldsborough a distance of
ninety-two (92) feet to land
formerly of Benj. Clifford,
et als;
Thence in nearly a northerly
direction by land last
named a distance of twen-
ty-four (24) feet and nine
(9) inches;
Thence southeasterly by
land formerly of James An-
drews, et al, a distance of
ninety-eight (98) feet to said
Alfred Street;
Thence southwesterly by
said Alfred Street a dis-
tance of twenty-two (22)
feet to the place of begin-
ning.
Together with and subject
to all of such rights as are
more specifically described
in an agreement between J.
Emile Thibodeau, et al and
Irving Sandler, et al dated
July 17, 1943, and recorded
at the York County Registry
of Deeds, Book 1006, Page
238, to which record thereof
reference is hereby made.
TERMS OF SALE: The
Mortgaged Premises shall
be offered for sale as a sin-
gle lot, commencing at
10:00 a.m., on December
29, 2016, at 44 Alfred
Street, Biddeford, Maine.
All bidders will be required
to deposit $10,000 in cash
or certified U.S. funds made
payable to Pierce Atwood
LLP, the Mortgagee’s attor-
neys, in order to register to
bid (the “Deposit”). The
high bidder will be required
to leave the Deposit as a
non-refundable down pay-
ment, and will be required
to increase the Deposit to
ten percent (10%) of the
purchase price within five
(5) days after the auction.
The high bidder will also be
required to sign a purchase
and sale agreement calling
for a closing within thirty
(30) days of the date of the
auction, at which time the
balance of the bid price will
be due in immediately avail-
able U.S. funds, and the
Mortgagee will deliver a du-
ly executed Quitclaim Deed
Without Covenant convey-
ing whatever right, title and
interest the Mortgagee has
in the Mortgaged Premises.
The Mortgagee and its
nominees and assigns, re-
serve the right to bid with-
out making the required de-
posit and, if the Mortgagee,
or its nominee or assign, is
the high bidder, to pay for
the Mortgaged Premises
with a credit against the
debt owed.

nounced prior to or at the
auction.
