ALFRED — An Old Orchard Beach man was indicted by the grand jury at York County Superior Court on charges resulting from an October vehicle crash in which his passenger died.

Brian Roche, 32, has been charged with manslaughter and operating under the influence causing death.

An indictment is not a finding of guilt, but a finding that enough evidence exists to move forward with prosecution.

According to police reports, Roche was driving on Log Cabin Road in Arundel, late at night on Oct. 26, and appeared to have lost control of the 2002 BMW sedan he was driving and hit a utility pole. Roche failed to negotiate a curve in the road, left the roadway and struck the utility pole near 198 Log Cabin Road, according to police reports.

His passenger, Bobby Hem, 26, of Sanford, was pronounced dead at the scene. Police said Hem had not been wearing a seatbelt.
