AUBURN (AP) — A Lewiston man convicted of killing his neighbor has had his bid for a new trial turned down.
Buddy Robinson appeared in Androscoggin County Superior Court last week where his attorneys argued he should be granted a new trial because the prosecutor improperly influenced the jury by gesturing and mouthing answers behind the back of the defense during closings.
The Sun Journal reports that the judge wrote in her decision this week that Robinson hadn’t met the burden of demonstrating that the prosecutor’s conduct caused “a harmful prejudicial error.”
Robinson was sentenced to 55 years in prison after he was convicted last year of the 2011 beating and drowning death of 22-year-old Christiana Fesmire, who lived in the same apartment building.
Robinson’s appeal to the Supreme Judicial Court is pending.
