BIDDEFORD — In April 2013 a Biddeford teenager driving on Portland Street in Berwick collided head-on with the vehicle of a Berwick woman, who was driving with her two children in the opposite lane.
On Thursday, the family of the woman, Amy Harris, who died as a result of the accident, filed a wrongful death lawsuit against the driver, Cameron Clair, and his parents, Michael and Cornelia Clair, at the York County Superior Court in Alfred.
The Harris family is seeking damages from the Clair family for funeral expenses, emotional distress and more, arguing that Cameron Clair “made negligent choices and took negligent actions violating multiple safety rules which exist to prevent crashes and protect against needless harm, injury and death on our state’s roads and highways,” according to court documents.
The plaintiff alleges that because Cameron Clair was under 18 at the time of the accident, and the vehicle he was driving was owned by his parents, Michael and Cornelia Clair should also be held liable for the damages.
According to court documents, Cameron Clair had recently suffered a concussion at the time of the accident, and both his parents were negligent in permitting him to drive as they knew he “had ongoing post-concussive symptoms that could prevent him from operating a motor vehicle safely.”
