GORHAM – The Gorham Planning Board on Monday again tabled a controversial request by Travis Caruso to reduce the size of a lot at 53 Phinney St., owned by C & C Family in Fort Hill Estates, from 4.6 acres to 1.4 acres.

Legal issues surrounding the item were previously discussed by planners on May 7, but the request was tabled.

“This is informational. We’re not looking for any vote tonight,” Edward Zelmanow, Planning Board chairman, said Monday.

Several neighbors are opposed to the Caruso proposal.

To gain Gorham Planning Board approval, Caruso is seeking to amend the Maine Department of Environmental permit for the development created four decades ago. Caruso hopes to join land from a lot split to a larger family-owned parcel where he wants to build a new home.

Gorham’s planning staff noted in a packet about the request that an email from the Maine attorney general’s office to the Department of Environmental Protection said deed restrictions would not allow an amendment to the DEP permit.

The town’s attorney for the Planning Board, Natalie Burns, in her legal opinion said the board should continue to review Caruso’s application.

Bernard Broder of 49 Phinney St., said 25 neighbors, some who had a lawyer present, were attending Monday’s meeting because the item had been placed on the agenda. He said the applicant didn’t have what’s required from the Department of Environmental Protection.

“I’m annoyed we’re here tonight,” said Broder, a lawyer.
