GORHAM – Arrested last week in Gorham, a fugitive from justice for more than three decades is being returned to Massachusetts, where he fled following conviction of rape and kidnapping charges stemming from 1978 at age 18.

Gary A. Irving, 52, accompanied by his lawyer, signed a waiver of extradition in Cumberland County Court Monday morning. Irving, a family man hiding under an alias, was taken into custody without incident by Gorham police and state troopers from Maine and Massachusetts at 8:23 p.m. on March 27 at his home on South Street in Gorham.

The Massachusetts State Police Violent Fugitive Apprehension Section had identified Gorham resident Gregg A. Irving as Gary A. Irving.

Brought into court wearing manacles, leg chains and a yellow jumpsuit, Irving has been held at Cumberland County Jail in Portland since his capture. When Irving disembarked a Cumberland County Sheriff Department bus outside the courthouse, he covered his face with his hands.

Gorham police said in a report that Irving was wanted on a Massachusetts Superior Court warrant that charged him with three counts of rape, kidnapping and unnatural acts.

After a brief court hearing Monday, Trooper Jeremy Forbes of Maine State Police said Irving would was to be picked up shortly to be returned to Massachusetts.

Irving signed the waiver Monday after Judge Roland Cole asked him if he understood the proceedings.
