A Windham man who withstood the ire of neighbors to gain approval for a quarry last year told Town Councilors this week that he has alerted police to trespassing on the site, where he has recently began to work.

During the open participation portion of Tuesday’s council meeting, Peter Busque said he was putting neighbors “on notice” that he was contacting police about trespassing on his property, 160 acres on the corner of Nash Road and Route 302. He said he has reports of neighbors on the property but did not elaborate further. He did not return calls later seeking comment.

Busque’s plan calls for a 55-acre quarry to be mined in four phases over 25 years. The application was approved late last year, and Busque planned to begin work on the quarry and surrounding area this spring. He has started work on part of the land that will not be used as a quarry, he said Tuesday.

The site has been a source of controversy since Busque first proposed a quarry in 2006. As the developer sought approval from the Planning Board and Town Council, a group of adjacent property owners and neighbors came forward to fight the plan, citing worries over excess noise, vibration and traffic.

After the quarry application was approved, neighbors filed a lawsuit in Cumberland County Superior Court. The lawsuit is still pending. The suit said there was no evidence in the record that showed the operation would conform to vibration limits.
