ELLSWORTH — An Ellsworth attorney who was disbarred last December after being accused of taking $189,000 from a client’s estate has been indicted by a Hancock County grand jury, which convened on Feb. 9 and 10.
Christopher Whalley, 63, has been indicted on one count of theft by misapplication.
Augusta attorney Walter McKee, who represents Whalley, said that his client has repaid all of the funds with interest. The Maine Attorney General’s Office is responsible for prosecuting attorneys accused of alleged crimes.
Attorney General’s Office spokesperson Danna Hayes said the state alleges that Whalley “acting in his capacity as an attorney and as personal representative of the estate of a late client, stole funds from the estate between 2019-2021. This criminal matter is related to the administrative proceeding Board of Bar Overseers v. Christopher J. Whalley.”
Maine State Police Detective Carleton Small investigated the case, which is being prosecuted by Assistant Attorney General Charles Boyle.
Whalley is scheduled for an initial appearance on Feb. 23.
