
The indictments charge Thomas Kimball, 22, with Class B felony aggravated assault and assault and reckless conduct, both Class D misdemeanors.
An indictment is not a finding of guilt; it is a finding that enough evidence exists to initiate prosecution.
The indictments stem from a Dec. 13 incident in which York County Sheriff’s Office deputies were informed by a third party that two adults and two children were in a residence on Trout Brook Road, off Route 111, and the male adult had assaulted the female adult.
In a statement issued following the incident, York County Sheriff William King said deputies were told that the man involved in the fracas was in possession of a weapon and had threatened to harm himself when police showed up.
“The male fled the residence with his gun before our arrival,” said King. “The female victim lost sight of him as he disappeared into the darkness.”
While initiating the investigation, deputies noticed two vehicles leave a nearby home. The deputies stopped the vehicles and found Kimball inside one of them.
He was taken into custody without incident and, King said; Kimball was not in possession of a weapon at the time of his arrest.
King said the subsequent investigation determined the weapon was stashed at a neighboring residence and was taken for safekeeping.
