WISCASSET – A lawsuit by Wiscasset business owners against the Maine Department of Transportation has reached a new chapter as the plaintiffs filed to have the dismissal reconsidered Thursday afternoon.
Wawenock, LLC, and several other businesses owned by Ralph Doering and family suffered a setback in a lawsuit against MDOT on Sept. 11 when all nine counts levied against the Route 1 project were dismissed. A decision by Judge Richard Mulhern of the Business and Consumer Court found in favor of the state’s motion for judgment, dismissing all nine counts against MDOT.
The latest development, a motion for reconsideration, asks the court to re-examine the decision, asserting, “The court erred in finding no private right of action arising out of the sensible transportation policy act.”
If the motion for reconsideration is denied, the plaintiffs can still seek an appeal at a later date.
