PORTLAND — A Standish man was in critical condition at Maine Medical Center on Monday after multiple surgeries for injuries he suffered during an alleged attack by a pair of men wielding a baseball bat and a crowbar, authorities said.
Ryan Wescott, 29, suffered life-threatening injuries in the incident Friday at the home of his brother, 25-year-old Shane Wescott, also of Standish. The younger brother was in satisfactory condition Monday.
Two Portland men are accused in the incident. Peter Tracy, 22, is charged with elevated aggravated assault and aggravated assault. Nicholas Richards, 23, faces two counts of elevated aggravated assault. They made their first court appearances in the case in Cumberland County Unified Criminal Court in Portland on Monday. No pleas were entered.
The men were arrested on Route 22 in Buxton shortly after 11 p.m. Friday, about half an hour after the alleged attack at Pine Tree Estates on Holiday Lane in Standish was reported to authorities, according to an incident report by Detective Howard Brown of the Cumberland County Sheriff’s Office.
Witnesses said there had been tensions between Tracy and Shane Wescott because Wescott is dating Tracy’s ex-girlfriend, the report said.
Assistant District Attorney Bud Ellis said in court that initial information suggests Tracy initiated contact with Ryan Wescott, and that Richards struck Shane Wescott with a crowbar after he tried to assist his older brother.
“It’s all pretty new and muddled and all that. It still needs to be sorted out,” Ellis said outside the courtroom.
Richards adamantly contests the allegations and says that he acted in self-defense, said Dylan Boyd, the attorney appointed to represent Richards at Monday’s court appearance. Richards has no criminal convictions and has strong ties to the community and a solid job history, the lawyer said.
Kevin Moynihan, who represents Tracy on an earlier criminal-threatening charge and represented him at the hearing, said he had few details about the Standish case.
Tracy was being held Monday on $100,000 cash bail. Superior Court Justice Roland Cole ordered bail set at $100,000 surety or $10,000 cash for Richards, who has a friend willing to put up the deed to his home to cover Richards’ bail, Boyd said. It was unclear Monday whether Richards had been released on bail.
According to the detective’s report, the Wescott brothers and two other people were at a home in Buxton when Shane Wescott received a phone call. He told the others he had to return to his home in Standish because someone was coming over to beat him up. Tracy and Richards apparently showed up at the Standish house in a Ford Explorer.
Ryan Wescott allegedly approached Tracy, who got out of the driver’s seat and pushed Ryan Wescott, who swung at Tracy but missed, according to the report. Tracy allegedly punched Ryan Wescott several times and he fell down. Tracy then removed a baseball bat from the Explorer and starting hitting Ryan Wescott with it, the report said.
Shane Wescott and a friend of the Wescotts — 31-year-old Nathan Huff — also became involved. Huff said Richards had a crowbar and chased him with it.
Authorities found a baseball bat and crowbar on the back lawn of a nearby property.
The sheriff’s office is investigating the case, but Maine State Police have been notified and are assisting. State police would investigate the case if it becomes a homicide, and the Attorney General’s Office would prosecute it.
