CARRABASSETT VALLEY – No criminal charges are expected following the collapse of a wooden deck that injured five people Saturday at the Rack bar and grill, Carrabassett Valley Police Chief Scott Nichols said Wednesday.

The collapse was “likely caused by the combined weight of too many people on it at the same time,” according to the State Fire Marshal’s Office in a news release from Maine Department of Public Safety spokesman Steve McCausland.

Nichols said in a phone interview Wednesday that he believes the collapse will be handled as an insurance issue. Nichols said he has interviewed witnesses, the town code enforcement officer and people hurt in the collapse, but found no building code violations. He plans to release his report by Friday.

The second-floor wooden structure met fire safety code regulations, McCarthy said.

Jeff Strunk has said he owns the bar and grill with snowboarder Seth Wescott, the 2006 and 2010 Olympic gold medal-winner, and Chase McKendry.

Nichols has said the bar and grill had a near-capacity crowd the night of the collapse, with people coming from the Reggae Festival held earlier Saturday at Sugarloaf ski resort.

The wooden structure collapsed beneath partygoers about midnight Saturday and sent at least 10 people tumbling 15 feet to the ground, according to Nichols. Five people were taken to the hospital with injuries ranging from broken bones to cuts and bruises, he said.

Those taken to the hospital, police said, were Monica Yesmentes, 50, Gardner, Mass.; Sandra Walczyk, 27, Old Town; Judd Vear, 25, Orono; Brescian Lander, 35, Orono; and Patrick Frisbee, 25, Eliot.
