WESTBROOK — A judge has approved a consent order that will allow Pike Industries to mine its quarry in the Five Star Industrial Park in Westbrook.

Superior Court Justice Thomas Humphrey issued his ruling this afternoon. The mine has been bitterly opposed by neighbors and some industrial park businesses.

Pike sued Westbrook last year after the zoning board ruled that the company didn’t have the right to operate the quarry.

Idexx Laboratories and other tenants of the park opposed the quarry. Idexx dropped its opposition after city officials and Pike crafted the agreement to allow the quarry to operate with some restrictions.

The agreement set limits on the mining operation. Artel, a biopharmaceutical company in the park, and Warren Knight of Smiling Hill Farms, sought to block the agreement at a hearing earlier this month.

A separate lawsuit filed by neighbors seeking to stop the mining is still pending in Cumberland Superior Court.
