A procedural snag this week bogged down a request that Buxton’s Planning Board reconsider a proposal to send a zone change to voters in June.

Patricia Leavitt, who is proposing Narragansett Business Park, owns a 26-acre Narragansett Trail property that is divided by zoning. Part is business commercial, but part is in the rural zone. A change in zoning requires approval by town voters in a referendum, but the Planning Board last month nixed putting the question on the June ballot.

This week, Leavitt was hoping the board would rehear her proposal. Seven members of the public attended.

Leavitt, executive director of Leavitt’s Mill Free Health Center in Buxton, said Tuesday her request was approved to appear on this week’s Planning Board agenda and she had planned to announce setting aside 6 acres for green space. “I was a bit startled,” she said Tuesday, about not being heard.

But Harry Kavouksorian, chairman of the Planning Board, said in the meeting the board faced a procedural issue that needed clarification.

“I need to consult the town attorney,” said Kavouksorian, who questioned rehearing the proposal.

Leavitt, who is weighing the option of whether to pursue a citizens’ petition to place the rezoning on the ballot, asked Monday for an explanation of the Planning Board’s procedural problem.

Jeremiah Ross, Planning Board vice chairman, said a reconsideration vote would be required before the board could reopen her proposal for a zone change. The board voted 3-2 last month not to send Leavitt’s proposal to town voters.

If one of the Planning Board members on the prevailing side were to make a motion to reconsider, the board Monday was unclear who could second the motion and who would be allowed to vote on a reconsideration motion. Those voting last month against sending the proposal to voters were Dave Anderson, Ross and Kavouksorian. James Logan and Keith Emery were in favor of voters deciding.

Planning Board members Dave Savage Sr. and Caroline Segalla were absent at last month’s vote. Anderson did not attend this week’s meeting.

Leavitt’s parcel is largely zoned business commercial but a portion at the rear of the property is in the rural zone. Leavitt wants to expand the business commercial zone to the property line.

In a separate agenda item this week, Walt Stinson of Sebago Technics presented plans for three lots in Leavitt’s proposed industrial business park. The lots are located in the business commercial zone part of the property. The site, which is across from Waterman Road, would be accessed by an entrance from Narragansett Trail, which is Route 202.

Leavitt would sell lots in the development to businesses that could include restaurants and repair shops. Leavitt has previously said she wants a parklike development with walking paths. Planning Board member Caroline Segalla said Monday she would like to see a landscaping plan for the project.

The Planning Board will review the site at 6 p.m. on Monday, April 6. The site walk is open to the public. The Planning Board will set a date for a public hearing on the proposed business park.
