Neighbors’ worries about a registered sex offender frequenting the Broad Cove neighborhood of Cape Elizabeth may dissipate now that the man is not allowed at a friend’s home there.

A restraining order has been filed against convicted sex offender Scott Alan Biller by the father of his long-time girlfriend, according to Capt. Brent Sinclair of the Cape Elizabeth Police Department.

Biller moved to town in late 2004 or early 2005, and was arrested in February on a charge of failing to inform local police that he was a sex offender. Biller is the first known sex offender in Cape Elizabeth, and still uses a post office box at the Cape Cottage Branch post office.

Norm Richman of Spoondrift Lane filed the restraining order on Tuesday, April 12, only days after a memo was circulated around the Broad Cove neighborhood warning residents that Biller had been seen frequenting the Richman residence. Richman could not be reached for comment.

“Scott Biller’s been visiting out there for years,” Sinclair said. “I think that he’s probably less of a threat” than other sex offenders who are unknown but might visit the neighborhood, or than sex offenders who are required to register but do not.

“He’s got eyes on him 24-7 down there,” Sinclair said, suggesting people should be cautious all the time. “I’ll guarantee you, if you’ve been out to the Maine Mall, you’ve walked by a sex offender and not even known it.”

Beth Hess, the president of the Broad Cove Neighborhood Association, stressed that the purpose of the memo and the concern of the neighborhood was only to inform people and make them aware of what went on in their neighborhood.

“The facts are out there and I hope it won’t become a personal issue,” Hess said. “(Biller) has his rights as well, information can only help.”

Biller has served time for his conviction and is free to go wherever he please without limitations and can have contact with children, the memo states, but, “it would be very helpful if the vigilance of the neighborhood residents should accompany Mr. Biller when he travels anywhere around the Broad Cove neighborhood.”

Biller has a 9 p.m. curfew, at which time he is required to be at the address he has listed as his residence, which is the Budget Inn on Route 1 in South Portland.

The Cape police had told neighbors they had stepped up patrols in the Broad Cove neighborhood. Now that there is a restraining order in place the problem might resolve itself, Sinclair said.
